LATOP ENERGY s.r.o.
Terms for enquiries and purchases of wood pellets and briquettes through latop-pelety.eu.

In these terms, ‘we’ means the seller identified above and ‘you’ means the customer. A consumer is an individual purchasing outside their business or independent profession.
These terms apply to purchases of pellets and briquettes agreed with us following an enquiry through this website, email or telephone. Individually agreed contract terms take priority, subject to mandatory law.
The website is a product catalogue and enquiry service. It does not provide an online checkout. Displaying a product does not guarantee current availability or constitute an offer that can be accepted merely by sending an enquiry.
Photographs illustrate the products and packaging. Before an order is accepted, we confirm the product type, quantity, packaging and relevant specifications. Agreed descriptions and statutory requirements remain binding.
For a quotation, tell us the product, quantity, delivery address or postcode and unloading requirements. We may request further details needed to prepare an accurate offer.
We provide a quotation setting out the goods, total price, applicable taxes, delivery and unloading charges, payment terms and proposed timing. These terms and the required pre-contract information are supplied before you place a binding order.
If you decide to order on the basis of the quotation, a purchase contract is concluded when we expressly confirm acceptance of that order by email. An acknowledgement that we have received an enquiry is not acceptance of an order. You can correct your details before ordering by contacting us.
The agreed order and these terms are confirmed by email so that you can retain them. Contracts are normally concluded in Czech unless another language is expressly agreed. You may request a copy of the contract documentation relating to your purchase.
Product prices are quoted individually. Before you commit to a purchase, we confirm the total amount payable, including VAT where applicable and all agreed transport, unloading, packaging and other charges. Any pallet or big bag deposit and its return conditions must be expressly stated in the quotation.
The payment method, currency and due date are those agreed in the accepted quotation or order confirmation. Payment instructions are supplied directly with that documentation. Do not treat submitting an enquiry as a payment request.
No additional service or charge is added without your agreement. Any subsequent change to the agreed order, price or delivery arrangement requires agreement between us, except where a right arises under mandatory law.
We supply goods in the Czech Republic. The delivery or collection location, timing and unloading method are agreed for each order. Details of the available transport arrangements are on our delivery page. A delivery date becomes contractual when it is agreed in the order confirmation.
Please provide accurate access information, including gate width, vehicle restrictions and the unloading surface. Where a Moffett forklift is agreed, access must accommodate the stated minimum gate width of 245 cm. Tell us about restrictions before we confirm the order.
Check the visible condition and quantity of the delivery on receipt. Report any damage or discrepancy to us promptly and, where possible, record it with the carrier and take photographs. Failing to record visible damage does not remove a consumer’s statutory rights.
For consumers, the risk of loss or damage passes on physical receipt by you or a person you designate, other than the carrier, subject to the statutory exception where you independently commission a carrier not offered by us. Ownership passes once the goods have been received and the agreed price has been paid in full.
If delivery cannot be completed, contact us to agree the next step. Any additional delivery or storage charge must have a lawful basis and be disclosed and agreed; it is not automatically imposed by this website.
Store pellets and wood briquettes in a dry place, protected from water and moisture. Observe the handling and storage instructions supplied with the goods. Use each fuel only in an appliance whose manufacturer permits it; wood pellets, wood briquettes and coal briquettes are not interchangeable in every appliance.
Damage caused after receipt by unsuitable storage, moisture, improper handling or use contrary to the appliance instructions is not a defect for which the seller is responsible. This does not limit rights relating to a defect that existed when the goods were delivered.
A consumer who concludes a purchase contract at a distance normally has 14 days from receipt of the goods to withdraw without giving a reason. For a single order delivered in separate parts, the period runs from receipt of the last part. Sending notice within the period is sufficient.
Send a clear withdrawal notice to [email protected] or to our postal address in Section 1. You may use the model notice in Section 12, but its use is optional.
Return the goods to us no later than 14 days after giving notice. You bear the direct return costs where we have informed you of this before the contract. For pallets or bulk goods that cannot normally be returned by post, we will provide the return-cost information required by law before you are bound by the order. Contact us to coordinate suitable transport; prior permission is not a condition of exercising the right.
We refund payments, including the cost of our least expensive standard delivery option, within 14 days after receiving the withdrawal notice. We may withhold reimbursement until the goods are returned or you provide evidence of dispatch, whichever occurs first, unless we have offered to collect them. Refunds use the original payment method unless you agree otherwise without additional cost.
You are responsible only for loss of value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Original packaging is not a condition of withdrawal.
Statutory exceptions apply, including goods made to your specifications and goods that become inseparably mixed with other goods after delivery. A product is not automatically excluded merely because it is supplied loose. A purchase concluded in person does not acquire a 14-day withdrawal right merely because the product was first viewed online.
We are responsible for supplying goods that conform to the contract. Consumers may assert rights for a defect that becomes apparent within two years of receipt, subject to the statutory rules. A defect appearing within the first year is presumed to have existed on delivery unless the nature of the goods or defect excludes that presumption.
Contact us at [email protected] or our address in Section 1. Describe the problem, identify the purchase and state the remedy you request. An invoice number, photographs, packaging label or batch information can help, but an original invoice is not the only way to prove a purchase. We will agree a practical inspection or return arrangement for bulky fuel.
Consumer remedies include repair or replacement, and, in the circumstances provided by law, a proportionate price reduction or withdrawal from the contract. We provide written confirmation of the complaint and its outcome. A consumer complaint, including notification of its resolution, is handled within 30 days unless a longer period is agreed with the consumer. Statutory rights apply if this deadline is missed.
Reasonable costs necessarily incurred in exercising a justified defect claim are reimbursed as required by law. Further information on consumer remedies is available from the Czech Trade Inspection Authority.
Where you purchase in the course of business, the consumer-specific withdrawal and complaint provisions do not apply. Your rights and obligations are governed by the agreed contract and the applicable provisions of Czech civil law.
Business customers should inspect deliveries and report defects without undue delay in accordance with the law. Any special quality assurance, acceptance procedure, risk allocation or contractual guarantee must be expressly agreed. These terms do not create an additional commercial warranty.
Contact and order details are used to answer enquiries, prepare and fulfil contracts, maintain required records and handle related claims. Sending an enquiry does not, by itself, give consent to unrelated marketing. For questions about the handling of your personal data, write to [email protected].
Please raise any complaint with us first so that we can seek a solution. If a consumer dispute cannot be resolved directly, the competent alternative dispute resolution body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Gorazdova 1969/24, 120 00 Praha 2, Czech Republic. Information and application instructions: coi.gov.cz/informace-o-adr.
An ADR application must generally be submitted within one year after the consumer first asserted the disputed right with the trader. This does not affect access to the competent courts.
The contract is governed by Czech law, particularly Act No. 89/2012 Coll., the Civil Code, and, for consumers, Act No. 634/1992 Coll., on Consumer Protection. The choice of law does not remove mandatory consumer protections that apply under the relevant conflict-of-law rules. Jurisdiction is determined by applicable law.
These terms do not restrict mandatory statutory rights. If a provision is invalid or unenforceable, the remaining provisions continue to apply where legally possible.
The version supplied when a contract is concluded applies to that contract. Later website changes do not retrospectively change an existing contract without agreement. The English version makes the terms accessible to English-speaking visitors; the contractual language is identified before the order is accepted.
Complete and send this notice only if you wish to withdraw from an eligible contract. You may instead send any other clear statement.
